In this episode, the collegium, naming former President KR Narayanan and current External Affairs Minister S Jaishankar, said, “In principle there can be no objection to Kripal’s candidature just because his partner is a foreign national.” The Supreme Court collegium reminded the central government about the decision of the Navtej Johar constitution bench on Kripal’s open acceptance of homosexual orientation. In this decision, it was said that every person is entitled to maintain his dignity and personality on the basis of sexual orientation. Therefore, rejection of Kirpal’s candidature for the post of judge on this basis would be contrary to the constitutional principles laid down by the Supreme Court. The collegium said, ‘Kripal has ability, integrity and intelligence. His appointment will add value to the bench of Delhi High Court by providing inclusiveness and diversity. His conduct and behavior have been beyond blame.

Collegium again sent Kripal’s name to the government
However, the Supreme Court also said that it would have been better if Kripal had not spoken to the media, accusing the government of stopping the appointment because of his sexual orientation. Significantly, on October 13, 2017, the Delhi High Court Collegium sent his name to the Supreme Court for appointment as a judge. Thereafter, the Supreme Court Collegium considered his name on four occasions on 4 September 2018, 16 January 2019, 1 April 2019 and 2 March 2021 respectively. It is a different matter that every time the decision was postponed in view of the strong opposition lodged in the intelligence reports focused on Kirpal’s foreign partner. In this episode, on November 11, 2021, the then CJI NV Ramana and Justices UU Lalit and AM Khanwilkar’s collegium recommended Kripal’s name to the government. The government returned it on 25 November 2022. Now on January 18, 2023, the Supreme Court has repeated his name again.
